4 YEAR IN-HOME FULL SERVICE WARRANTY
T
his warrantyis providedby InSinkErator®,a divisionof EmersonElectric Co.,(“InSinkEra-
tor”or “Manufacturer”or “we”or “our” or“us”)to the originalconsumer owner of the In-
SinkErator product withwhich this warrantyis provided (the “InSinkEratorProduct”),and
anysubsequent owner of the residence in which the Product was originally installed (“Cus-
tomer”or “you” or“your”).
InSinkEratorwarrants toCustomerthatyourInSinkEratorProductwillbefreefromdefectsin
materialsandworkmanship,subjecttotheexclusionsdescribedbelow,fora periodof4years
(the“WarrantyPeriod”),commencingonthelaterof:(a)thedateyourInSinkEratorProductis
originallyinstalled,(b)thedateofpurchase,or(c) thedateofmanufacture as identified by
yourInSinkEratorProductserialnumber.Youwillberequiredtoshowwritten documentation
supporting(a) or (b).Ifyouareunabletoprovidedocumentationsupportingeither(a)or(b),
theWarrantyPeriodcommencementdate willbedeterminedbyManufacturer,initssoleand
absolute discretion,baseduponyourInSinkEratorProductserialnumber.
What is Covered
Thiswarrantycovers defects inmaterials orworkmanship,subject to theexclusionsbelow,
in InSinkEratorProductsused by aconsumerCustomerforresidentialuse only, andincludes
all replacementparts andlaborcosts.YOURSOLE AND EXCLUSIVE REMEDY UNDERTHIS
LIMITED WARRANTY SHALL BELIMITED TO REPAIR ORREPLACEMENTOF THE INSINKER-
ATORPRODUCT.
What is notCovered
Thislimited warrantydoes not extend to and expresslyexcludes:
• Lossesor damagesor the inabilitytooperateyourInSinkEratorProductresultingfrom
conditionsbeyondthe Manufacturer’scontrol including,withoutlimitation,accident,alter-
ation,misuse, abuse,neglect,negligence (otherthanManufacturer’s), failure to install,
maintain,assemble,ormount the InSinkEratorProductin accordancewith Manufacturer’s
instructionsorlocalelectricalandplumbingcodes.
• Wearand tear expectedto occur during thenormal courseof use,including withoutlimita-
tion, cosmeticrust, scratches,dents orcomparable and reasonably expectedlosses or
damages.In additionto the aboveexclusions, this warranty does not apply to InSinkErator
Productsinstalledin acommercial orindustrialapplication.
No Other Express WarrantyApplies
Thiswarrantyis the sole and exclusivewarrantyprovidedtothe Customer identified above.
No other expresswarranty, written orverbal,applies. No employee,agent, dealer,or other
personis authorized to alter thislimited warrantyor makeanyother warrantyon behalf of
Manufacturer. The terms of this warrantyshall not bemodifiedby theManufacturer, the
original owner,or their respective successorsor assigns.
What we will do toCorrect Problems
If yourInSinkEratorProduct does not operate in accordance with the documentation pro-
vided to you, oryouhave questions concerningyour InSinkEratorProductor howto deter-
mine when service is needed,pleasecall thetoll free InSinkEratorAnswerLine™at 1(800)

Thefollowinginformation mustbeprovidedaspartofyourwarrantyclaim:yourname,
a
ddress,phonenumber,yourInSinkEratorProductmodelandserialnumber,andif neces-
sary,uponrequest,written confirmationofeither:(a)thedateshownonyourinstallation
receipt,or (b)thedate shownonyourpurchasereceipt.
Manufactureror its authorizedservice representative will determine, in its sole and ab-
solutediscretion,if your InSinkEratorProductis coveredunder thiswarranty. You will
be given the contact informationfor your closestauthorized InSinkEratorService Cen-
ter. Pleasecontactyour InSinkEratorServiceCenterdirectly to receivein home war-
ranty repair orreplacementservice.Only anauthorized InSinkEratorservice
representativemay providewarrantyservice.InSinkErator is not responsible for war-
ranty claims arising from work performedon your InSinkEratorProductby anyone
otherthan anauthorized InSinkEratorservicerepresentative.
If acovered claimis made during the WarrantyPeriod,Manufacturerwill, through its
authorizedservice representative, either repair or replaceyourInSinkEratorProduct.
Cost of replacementparts ora new InSinkErator Product,and cost of labor for repairor
installationof the replacementInSinkEratorProduct are providedat nocost to you. Re-
pairor replacement shall bedeterminedby Manufactureror itsauthorizedservice
representativein theirsole discretion. All repair and replacement serviceswill bepro-
vided to you atyourhome. If Manufacturerdeterminesthat your InSinkErator Product
mustbe replaced rather than repaired,the warrantyon thereplacementInSinkErator
Productwill belimitedtothe unexpired term remaining in the original WarrantyPeriod.
Limitation of Liability
TOTHE EXTENTPERMITTED BY LAW, INNO EVENTSHALL MANUFACTURER OR
ITSAUTHORIZED SERVICE REPRESENTATIVES BE LIABLE FOR ANY INCIDENTAL,
SPECIAL,INDIRECT, ORCONSEQUENTIALDAMAGES,INCLUDING ANY ECONOMIC
LOSS,WHETHER RESULTING FROM NONPERFORMANCE, USE, MISUSEOR INABIL-
ITY TO USE THE INSINKERATOR PRODUCT OR THEMANUFACTURER’S OR ITS AU-
THORIZED SERVICE REPRESENTATIVE’S NEGLIGENCE. MANUFACTURER SHALL
NOTBE LIABLEFOR DAMAGESCAUSED BY DELAY IN PERFORMANCE AND IN NO
EVENT, REGARDLESS OF THE FORM OF THECLAIM OR CAUSEOF ACTION
(WHETHER BASED IN CONTRACT, INFRINGEMENT, NEGLIGENCE, STRICT LIABIL-
ITY, OTHER TORT OR OTHERWISE), SHALL MANUFACTURER'SLIABILITY TO YOU
EXCEEDTHE PRICEPAIDBY THE ORIGINAL OWNER FOR THE INSINKERATOR
PRODUCT.
Theterm “consequentialdamages”shall include,but not belimitedto,loss of antici-
patedprofits,business interruption, loss of use orrevenue, costof capitalor lossor
damage to propertyor equipment.
Somestatesdo notallow the exclusion or limitation ofincidental or consequentialdam-
ages,so the above limitationmay not applyto you. This warranty gives you specific
legal rights and you mayalso have other rightswhich vary fromstatetostate.
